Court Imprisons Herdsman For Beheading Friend

A 25-year-old herdsman, Habeeb Aliu, of Sunbare village, Banni, Kwara State, who beheaded his friend during a fight, has been remanded at the Federal Prison yard, Ilorin.

The order to remand the accused was made by an Ilorin Magistrates’ Court before, which he appeared on a one-count charge of culpable homicide, contrary to Section 221 of Penal Code Law.

The deceased, Umar Ismail, had left to graze on September 25, 2018, but never returned home.

However, when a search party was conducted, the victim’s lifeless body without the head was found in a bush.

The Police First Information Report (FIR) stated that investigation into the matter led to the arrest of the accused who was said to have earlier told the parents of the deceased that their son had gone to graze somewhere in the bush and that they should not look for him.

The FIR stated further that the accused confessed that there was a misunderstanding between them, which led to a serious fight.

It added that in the course of the fight, the accused beheaded and killed Umar with the use of a cutlass.

The prosecutor, Corporal Ayeni Gbenga, who told the court that the alleged offence was capital in nature and not ordinarily bailable, said that investigation was still in progress.

He opposed the bail of the accused and urged the court to remand him in prison custody pending the outcome of investigation.

The magistrate, Mrs MD Dasuki, who declined to take the plea of the accused for lack of jurisdiction to try the matter, acceded to the submission of the prosecutor and ordered that the accused be remanded at the Federal Prison Yard, Ilorin until the next adjourned date.

The court adjourned the case till October 16 for further mention.
